Davies versus Mann

Professor A. Robert Southwell taught tort law to first-year students at Gonzaga Law School. A foundational case in tort law is Davies v. Mann, a decision in English Common Law from 1842, which established the “last clear chance doctrine” in negligence law. Gonzaga employed the Socratic method of instruction, where students were randomly selected to recite the facts and law of a particular case and respond to questions from the professor. The students were expected to prepare for class, anticipating that it would be their turn to recite the case being studied that particular day. I came to class with this poem, and, of course, I was called upon to recite it. Professor Southwell was a man of good humor, as were my classmates when they heard my poem.
